Terms of Service

1. Acceptance of Terms

By accessing or using QuerySMS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2. Description of Service

QuerySMS is an SMS-based search service that allows users to send text messages with questions and receive AI-powered answers via SMS. The Service uses third-party AI technology (Perplexity AI) to process queries and generate responses.

The Service requires users to create an account, verify a phone number, and purchase credits to use the service. Each query consumes credits as specified in the pricing information.

3. Account Registration

To use the Service, you must:

  • Create an account using a valid email address
  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Verify at least one phone number linked to your account

You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.

4. Phone Number Verification

To use the SMS search functionality, you must verify at least one phone number. By linking a phone number to your account, you:

  • Represent that you own or have authorization to use the phone number
  • Agree to receive SMS messages at that number
  • Understand that standard SMS rates may apply
  • Accept responsibility for any queries sent from that number

5. Credits and Payment

The Service operates on a credit-based system:

  • Each query consumes credits as specified in the current pricing
  • Credits must be purchased before use
  • Credits are non-refundable except as required by law
  • Credits do not expire unless your account is inactive for an extended period
  • Pricing may change at any time, but changes will not affect credits already purchased

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.

All prices are in USD unless otherwise stated. You are responsible for any applicable taxes.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Send spam, harassment, or abusive content
  • Attempt to reverse engineer or compromise the Service
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or harvest information about other users

We reserve the right to suspend or terminate accounts that violate these terms.

7. Service Availability

We strive to provide reliable service but do not guarantee:

  • Uninterrupted or error-free service
  • Immediate response times
  • Accuracy of AI-generated responses
  • Availability of third-party services (Perplexity AI, Bird)

The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

8. AI-Generated Content

Responses generated by the Service are created using AI technology and may:

  • Contain inaccuracies or errors
  • Be incomplete or outdated
  • Not reflect our views or opinions

You should verify important information independently. We are not responsible for decisions made based on AI-generated responses.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by QuerySMS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of the Service without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for credits in the 12 months preceding the claim
  • We are not responsible for actions or content of third-party services

11. Indemnification

You agree to indemnify and hold harmless QuerySMS, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuerySMS operates, without regard to its conflict of law provisions.
